YAHOO (NASD: YHOO) and CARL ICAHN have struck a deal that will give Icahn three positions on the Yahoo Board. Icahn and two appointed directors would join the Yahoo board, which would stay completely intact. The agreement comes after months of nasty letters and press releases, and a week before Yahoo’s annual shareholder meeting.

A Federal Appeals Court has thrown out the FCC’s indecency fine issued to CBS (NYSE: VIA) over the infamous Janet Jackson “nip slip” at the Super Bowl. The Court ruled that the FCC deviated from its stance of fining broadcast programs “pervasive as to amount to ‘shock treatment’ for the audience.”

APPLE (NASD: AAPL) announced its third-quarter earnings were up 31%. Coincidently, Apple sold more Macs this quarter than ever before. Steve Jobs, who often sits in on conference calls with investors, was not present at the time of the report.
